Privacy Policy (version 1.0, June 21, 2010)
The privacy and security of visitors to the Rainier Software, Inc. (“Rainier”) community of websites (the “Rainier Community”), including this website (the “Site”) and directory listings (the “Listings”) published there is very important to us. This Privacy Policy describes how we collect, protect and use personally identifiable information (“PII”) we receive from Site visitors and Listings.
Also, by accessing or using the Site, you are accepting and agreeing to the practices described in this Privacy Policy and any future updates to the policy. As you are probably aware, the Site contains numerous links to other websites over which we have no control. We are not responsible for the privacy policies or practices of other websites to which you choose to link from our Site. We encourage you to review the privacy policies of those other websites so you can understand how they collect, use, and share your information.
Some of the Site pages may be provided for informational purposes and you may be able to use the Site without telling us who you are or providing us with any PII. There are times, however, when in connection with your use of this Site we will need information about you.
What
Information We Collect
Listing Information
To add a Listing for your organization on the Site, you will need to register
and create a profile that will be stored on our servers. You will need to
provide PII such as your organizations name, website URL, address, phone
number, the type of services you provide and other information that is
requested from time to time and clearly stated on the Site. After a review by
our staff to ensure the Listing for your organization is appropriate, this
information will be published on the Site and other Rainier Community websites.
As part of your Listing we also collect the email address you want people who
are interested in your organization to send their enquiries to (the “Contacts”)
as well as information we may use to contact you for any reason including to
verify your Listing. This contact and verification information will not be
published on the Site. None of the Listing information collected will be
shared, sold or used in any way by anyone other than Rainier. We may change the
types of information that are required and any such changes will be clearly
indicated on the page where you are required to create your listing.
Contact and Tell-a-Friend Information
To send a contact form (the “Contact”) to one of the Listings on the Site or to send a tell-a-friend form (the “Tell-a-Friend”) about one of the Listings on the Site you will need to provide your name and email address. All information collected about you, including the optional personal message, will be sent to the Listing for Contact’s and to the email address of your friend(s) for Tell-a-Friends. Both will include a copy emailed to the email address you provided that includes the full Listing. None of the Contact or Tell-a-Friend information collected will be shared, sold or used in any way by anyone other than Rainier. We may change the types of information that are required and any such changes will be clearly indicated on the page where you are required to create the Contact or Tell-a-Friend.
Review Information
To add a review (a “Review”) for a Listing on the Site, you will need to provide PII such as your name, email, the date and type of the activity participated in and other information that is requested from time to time and clearly stated on the Site. After a review by our staff to ensure the Review is appropriate, the Review will be published on the Site and other Rainier Community websites. A copy of the Review, without any PII, will also be sent to the Listing with a copy to you. None of the Review information collected will be shared, sold or used in any way by anyone other than Rainier. We may change the types of information that are required and any such changes will be clearly indicated on the page where you are required to create your Review.
Our Use
of Cookies
A "cookie" is a small piece of information in a text file that many
websites use to simplify your online experience. We write this information on
your hard drive, and we retrieve it when you visit our site. No one else can
read a cookie that we write, and we cannot read cookies from other websites.
Our cookies do not contain any personal information; they simply identify the
computer you are using by your IP address. When you visit our site, the cookie
helps us understand how you navigate from page to page on the Site. Cookies
help us design the Site in a way that is easy to use and comfortable to our
members. Your browser allows you to control whether and when websites write

Third-Party
Cookies and Web Beacons
We may allow third-party advertisers to display advertisements on the Site.
These advertisers may also place cookies on your computer or use other
technologies such as “web beacons” to recognize your computer each time they
display an advertisement to you, evaluate the effectiveness of their
advertisements, and personalize advertising content. These advertisers may be
able to compile information about where you, or others who are using your
computer, viewed or clicked on the advertisements they display. Like cookies,
web beacons are not associated with any of your personal information. We have
no access to or control of the cookies the third party advertisers may place on
your computer. This Privacy Policy applies to the use of cookies by Rainier
only, and does not apply to the use of cookies or other tracking technologies
by any of the third-party advertisers.
How We
Use Your Information
Our primary goal in collecting PII is to provide a relevant experience on the
Site matching visitors with appropriate Listings and activities. We will not share
PII with any outside parties except as set forth in this Privacy Policy. Please
particularly review “Disclosing PII” below for details on how and why we may
share PII.
Communicating
With Listings
We will use your PII to send Listings service-related communications from time
to time. We may send communications such as a Listing confirmation email, verification
email or phone call, notifications, webinar invitations, new functionalities
added to the Site, or responses to your inquiries. By accepting this Privacy
Policy you expressly agree to receive this information. You can always opt out
of receiving these communications.
Communicating
with Site Visitors Interested in Listings
We will use your PII to send Contact and Tell-a-Friend information as submitted.
Disclosure
of PII
Some PII is disclosed to other users of the Site under certain circumstances.
An example is a Contact email. We will also disclose personal information about
an individual user if we believe in good faith that such disclosure is
necessary to comply with an applicable law or valid legal process. We may
collect and then disclose non-personally-identifiable information on an
aggregated basis to third parties. This means that (a) we won’t include things
like names and full addresses, but may include things like zip codes and gender
of user and (b) the information from many participants is grouped together in a
way that does not disclose the information of any particular participant. These
aggregate data collections are usually used for marketing and business
intelligence purposes. In addition to the disclosures described above, PII may
be provided occasionally to outside auditors, consultants, and others we hire
for routine website operations, solely to the extent necessary to help us
manage email communications with our members, or for other standard business
activities. We ask all recipients to agree to protect the confidentiality,
security, and integrity of the information. Also, we may disclose and transfer
your personal information to a third party who acquires all or a substantial
portion of our business, whether by merger, consolidation or purchase of all or
a substantial portion of our assets. In addition, if we become the subject of a
bankruptcy proceeding, whether voluntary or involuntary, we or our trustee in
bankruptcy may sell, license or otherwise dispose of such information in a
transaction approved by the bankruptcy court. We will notify you of a sale of
all or a substantial portion of our business to a third party via email or
through a prominent notice posted on the Site.
Linked
Websites
The Site contains numerous links to partners, advertisers and third party
Internet sites and services that may collect data in connection with
registrations, promotions, e-commerce, etc. These websites have their own
policies regarding privacy and content that are not under our control. We
encourage you to read the privacy policies of these sites. Please understand
that we have no responsibility for linked websites and provides these links
solely for the convenience and information of our visitors. If you click on a
website link, we do not send any personal information to that website unless we
have advised you about the disclosure. Please contact us if you have any questions
or concerns about any links that you find on our site.
Security
We use a variety of security measures to help maintain the safety of your
information. All PII we collect is stored in a secure database which is
protected by a firewall and hosted in a high security operating environment
that is monitored 7 x 24 and not accessible by the public. However, we cannot
guarantee that those measures will be effective or that unauthorized third
parties will never be able to defeat those measures or use your PII for
improper purposes.
Changes
to Our Privacy Policy
This Privacy Policy has a version number and date. If we change the policy, we
will also change the version number and date so users can tell that a change
has been made. We may make minor changes from time to time as our services
change, as our relationship with other partners develops, and as the Internet
evolves. If we plan to make a significant, material change in the way in which
we collect, use, or disclose PII, we will notify Listings of the change by
email and by a prominently posted notice on the Site. You will have a choice as
to whether or not we use your information in this different manner. In
addition, if we make any material changes in our privacy practices that do not
affect user information already stored on our servers, we will post a prominent
notice on the Site notifying users of the change

that we may better address your concerns:
a) In the subject line, type: 'Rainier Community Privacy Policy;'
b) Specify the exact nature of the potential breach of principles in detail;
c) Provide us with all necessary contact information for follow-up response.
d) We will use all commercially reasonable efforts to determine if corrective action is necessary and if so, remedy the problem promptly.
